The Town implemented an Administrative Monetary Penalty System for parking offences in July 2022. This system introduced an alternative dispute resolution process for parking offences, replacing the traditional Provincial Court system. Administrative Penalties are, as the name suggests, penalties imposed administratively through regulatory authorities to promote compliance with laws where there has been non-compliance. An AMP system provides control to the municipality with respect to the timelines associated with the life of a penalty notice, as the backlogged Provincial Court system no longer hinders the process. By doing so, the Town can offer a faster resolution process to the public without having to pay for costly prosecutions or being required to remit service fees to Halton Court Services

The Administrative Penalty process is designed to ensure fairness, efficiency, and consistency in resolving By-law offence disputes. Administrative penalties are imposed without a court hearing, so mandatory policies are established to ensure that the process for imposing a penalty is fair and in accordance with the principles of natural justice. For example, there are policies to address conflicts of interest, interference, and public complaints, among others. The AMP system has been upheld by the courts as appropriate for matters under provincial control.

Staff is proposing to implement an AMPS By-law for all of the Town’s regulatory bylaws. This is to build on what began with only parking offences and continue to improve service excellence, enhance staff efficiencies and effectiveness, provide an expedited and fair dispute process for customers, and ease the resolution burden in the provincial court system.
